Judicial Review 2024

The High Court Judicial review agreed with Love Te Arai that the community should have been notified
July 12, 2024

Because we care about our natural environment, the protection of animals
and plants and a safe environment for all who live at or visit Te Arai, we
have held Auckland Council to account with a High Court judicial review for
a non-notified consent.
The Lake Road quarry site at 203 Lake Road was closed in 2020 by the
Environment Court. Love Te Arai had stood against notified consents to
retrospectively make the quarry compliant and to extend the quarry
operations.
However in 2023 we noticed activity at the old quarry site and when we
talked to the council found they had granted consent, in January 2022
without notification to the public, for the old Lake Road Quarry site to be
used as a contractor's yard and storage depot with 300 truck movements
per week.
Legal advice confirmed for us that Auckland Council should have notified
the new consent and so Love Te Arai asked for a High Court judicial review
of Auckland Council's non-notification of the consent.
In February 2024 we received the judgement from the High Court whose
decision is that Auckland Council erred in deciding the non-notification of
the consent and this means that the consent is no longer valid.

We are a group called
LOVE TE ARAI

Founded in our community, we have banded together to preserve and enhance the natural ecology of the Te Arai region.
As a group, we help trap pests, do regenerative planting, treat kauri for dieback, monitor rare birds (Fairy Tern, Australasian Bitterns), and remove plastic from our beaches.
We are involved in caring for Te Arai so people who venture to our beautiful regional park, beaches, walking tracks, golf courses, horse riding trails, and events can enjoy the pristine environment.
